Terms of Service for Nextgenclassroom.se

Welcome to Nextgen Classroom, a learning platform for language teachers. Below you will find our Terms of Service.

General

Welcome to nextgenclassroom.se (also referred to as the “services,” the “service,” or the “platform”), provided to you (also referred to as the “user” or “you”) by Nextgen Classroom AB, registration number 559435-3137, with address Framtidsvägen 14, 352 22 Växjö, Sweden (also referred to as “Nextgen,” “we,” or “us”).

Your use of the services on nextgenclassroom.se (the “website”) is governed by these Terms of Service.

By clicking “Accept our Terms of Service” when creating a user account on the website, you agree to and undertake to comply with these Terms of Service.

The personal data you may provide to us when creating a user account and using the service, or when communicating with us, is processed in accordance with our Privacy Policy or in accordance with the data processing agreement we enter into with the municipality/educational authority regarding our services.

The service is intended for teachers who teach languages within the Swedish school system, in secondary school, upper secondary school, and adult education (Komvux). Students under 18 use the service as part of their education and in accordance with instructions and invitations from their school or teacher. Teachers invite and add students to teaching groups created by the teacher. Students must be at least 13 years old to use the platform.

Please note that we cannot provide the services to you unless you accept these Terms of Service.

User account

To use the services, you must create a user account and log in at nextgenclassroom.se. You undertake to comply with these Terms of Service when creating a user account.

When creating a user account, you will be asked to provide certain information about yourself, such as the school at which you are employed. This information will be used to provide the services to you. Read more about how we handle your personal data in our Privacy Policy.

To verify that you are authorized to use the service, you grant us the right to obtain verification information, such as phone number or email address of appropriate school representatives, for example in school management or administration.

Your user account is personal, and you may not transfer it to any third party. You are responsible for protecting your login credentials so that no unauthorized person gains access to your account. You are also responsible for not sharing (intentionally or negligently) your login credentials with any third party or otherwise allowing a third party to use your account or access the services. If you have reason to believe that a third party has gained access to the services, you must immediately notify us. We have the right, but not the obligation, to suspend access to your account if we have reason to believe that a third party has gained unauthorized access to it.

Using nextgenclassroom.se

As a user of Nextgen Classroom, you may be either a teacher or a student.

Using nextgenclassroom.se as a teacher

The teacher creates an account and can then create teaching groups and various types of assignments. Within their teaching groups, the teacher can assign different types of lesson materials and assignments, such as vocabulary practice (including AI-generated voices), exit tickets, conversation exercises, AI chats, text submissions, video submissions, and audio recordings (collectively referred to as “assignment” or “assignments” in the following text). Some assignments may partly or fully contain AI-generated content. Created assignments are considered User Content, and their use is governed by a separate section further below.

Each assignment is subject to a number of settings made by the teacher. Once created, the teacher can choose to provide students with access to the assignment by assigning it to a teaching group. Students gain access by entering the teaching group and clicking on the assignments provided by the teacher.

The assignments that students work on can be viewed, read, and monitored by the teacher in the left-hand menu inside each teaching group.

Using nextgenclassroom.se as a student

A student using nextgenclassroom.se gains access to assignments and materials from their teacher via a teaching group. These may include text submissions, exercises, video submissions, and audio recordings. When a student registers their account, certain basic information is collected, such as name, school, email address, and any profile picture. The purpose of collecting this personal data is to enable the platform’s core functionality and to allow the teacher to view and follow the student’s work and responses. All processing of personal data is carried out in accordance with our Privacy Policy or in accordance with the data processing agreement we enter into with the municipality/educational authority.

Only the teacher of the respective teaching group can see what the student does in their assignments. Nextgen Classroom AB collects students’ personal data solely for the purpose of allowing the teacher to follow the student’s work.

The responsibility for obtaining consent from the student or the student’s guardian, where applicable, for Nextgen Classroom AB to provide the service to the student and process the student’s personal data, lies with the school and its governing authority.

Uploaded content and code of conduct

As a teacher, you are responsible for all user content or other information or communication that you upload to the website.

You accept and warrant that you will not publish, disclose, transmit, distribute, or upload material to the website and/or services that:

  • is false, misleading, untrue, or inaccurate

  • promotes or encourages illegal activity

  • is racist or ethnically offensive and/or constitutes agitation against a minority (such as a national or ethnic group)

  • is defamatory, contains pornography, or is otherwise sexually offensive

  • constitutes an attack on sexual orientation or religion, or is otherwise discriminatory, or

  • is in any way harmful, offensive, abusive, illegal, or infringes the rights of third parties (including but not limited to copyright and trademarks).

Furthermore, you accept and warrant that you will not, and will not allow any third party to:

  • use the website and/or services to transmit or upload files or other content containing viruses, trojans, corrupted data, malware, or other software that may damage computers or property

  • use the website and/or services to defame, harass, discriminate, or threaten another person or otherwise violate another person’s rights

  • distribute or reproduce all or parts of the website and/or services

  • modify, disassemble, or decompile any part of the website and/or services, unless expressly permitted by mandatory law

  • use software that automatically reads data from the website and/or services

  • use the website and/or services to request or encourage another user to violate these Terms of Service

  • misuse the website and/or services or use them for any unlawful or unauthorized purpose (including spreading computer viruses or using the website and/or services in a way that infringes or violates another’s rights).

The services may allow you to send messages to other users, for example between teachers and students or between teachers. In addition, some assignments may include interactions via AI chats. You are responsible for all messages you send when using the services and you warrant that you will not send messages in violation of these Terms of Service, nor harass or threaten other users.

If you receive messages or images that you believe constitute a violation of these Terms of Service, or otherwise believe that the website and/or services are being used for illegal purposes or purposes inconsistent with these Terms of Service, please contact us at info@nextgenclassroom.se.

We reserve the right to immediately remove content from the website that we, at our sole discretion, deem not to be in compliance with these Terms of Service or with policies published on the website, or that is otherwise harmful to us or our users.

Limitation of liability

The website and services are provided “as is” without warranties of any kind, and your use of the services is solely your responsibility. We do not make any warranties, express or implied, regarding the availability, quality, fitness for a particular purpose, suitability, or accuracy of the website or services.

Internet connection and technical environment

Nextgenclassroom.se is a cloud service where the user creates a personal account. The availability and functionality of the services depend on several technical aspects beyond our control, including but not limited to internet connection, server capacity, and SSO login. Nextgen Classroom is not responsible for the functioning of these external technical aspects. You hereby accept that there may be situations when the services are not available for your use, including but not limited to technical maintenance and circumstances beyond Nextgen Classroom’s control, for which Nextgen Classroom is never responsible. We also do not take responsibility for any charges associated with establishing and maintaining access to the services, such as operator fees or roaming charges.

Intellectual property rights and user content

You understand and accept that the website and services contain material provided by us and third parties, and that such material may contain intellectual property rights.

You undertake to respect all intellectual property rights, including but not limited to copyright, trademarks, and trade names (whether registered or not) included or displayed on the website or that you access through the services. The above also applies to compilations of data and materials on the website that are to be considered a database.

By accepting these Terms of Service, you are granted a non-exclusive license to use the services for the purpose specified under “Using nextgenclassroom.se.” You do not have the right to use the services for any other purpose, and you may only use the content on the website for your own use of the services. You may not use the content on the website in violation of applicable law or these Terms of Service.

You are not granted any other license to use the aforementioned intellectual property rights except as expressly stated in these Terms of Service.

You understand and accept that content published on the website may belong to third parties, and that we do not control such content. You therefore understand and accept that we cannot be held responsible for such third-party content made available on the website or through the services.

Some parts of the service contain AI-generated material. Nextgen Classroom strives for high quality but cannot guarantee that such material is always accurate, complete, or free from errors.

License to user content

You may upload written comments, data, text, images, audio recordings, video recordings, exercises, tests, and other information (“user content”) to the website. It is permitted to use the platform for educational purposes, such as providing feedback, assessments, and comments on students’ work. However, it is not permitted to upload sensitive personal data within the meaning of the General Data Protection Regulation (GDPR) (e.g., data concerning health, religion, political opinions, or ethnicity) or classified materials not intended for the platform (e.g., scanned national exams).

Ownership of all user content belongs to you, or to the third party that owns such content.

We are granted a non-exclusive license to all user content solely to ensure that the service functions as specified under “Using nextgenclassroom.se.”

You warrant that you have all necessary rights to display and upload user content, to use the user content in all other ways, and to grant us a license to the user content as above. If any user content infringes the intellectual property rights of a third party, you agree to immediately remove all infringing parts of the user content and indemnify us for all damages, costs, and expenses incurred by us as a result of such infringement.

We may review parts of the user content but do not guarantee that all content will be reviewed. We reserve the right to remove user content if it violates the Terms of Service, risks liability, is deemed not to be of sufficient quality, is identical to existing content, or for any other reason is not considered to contribute to a better service.

If we become aware of, or have reason to suspect, that user content infringes the intellectual property rights of a third party, we have the right, but not the obligation, to remove such user content from the website and may suspend access to your account temporarily or permanently.

Anonymized data

When using the services, information and metadata are generated regarding how the services are used and knowledge development over time, such as information about how often users log in, what types of assignments are created, and how they are used. This information is anonymous and cannot be directly or indirectly linked to specific users or otherwise to identified individuals (“anonymous, aggregated data”).

For the purpose of understanding and further developing the services, nextgenclassroom.se owns the rights to anonymous, aggregated data. This means that nextgenclassroom.se has the right to analyze, interpret, license, and transfer anonymous, aggregated data.

Indemnity and limitation of liability

You are responsible to us for all damages caused to us, or third parties, due to your breach of these Terms of Service, including but not limited to misuse of the website and/or services. Furthermore, you agree to indemnify us for all claims, costs (including reasonable legal costs), damages, expenses, compensation, and losses we incur in any way in relation to your breaches of these Terms of Service.

To the extent permitted by mandatory law, we are not liable to you or any third party for any direct, indirect, or other damages of any kind, including but not limited to lost profits, loss of income, reduced revenue, business interruption, or loss of goodwill, arising from or in connection with these Terms of Service or the inability to use the services or website. We are not liable to you for any third-party claims made against you.

Changes to the Terms and termination of the services

We have the right to change these Terms of Service. We will notify you of upcoming changes on the website or by email to the email address you have provided.

You have the right to terminate your account at any time without prior notice. Termination and deregistration of an account is done by emailing: info@nextgenclassroom.se.

We have the right to suspend your access to the services with immediate effect if we have reason to believe that you are breaching these Terms of Service. Furthermore, we reserve the right, at our sole discretion, to modify, discontinue, or temporarily or permanently cease providing the services at any time without prior notice, or if required by law or government decision. You agree that we are not liable to you or any third party for such modification, discontinuation, or cessation.

Assignment of this agreement

You may not assign or transfer any rights, obligations, or licenses arising from these Terms of Service.

If the ownership of our business changes, we may, at our sole discretion, assign and transfer these Terms of Service, information, user accounts with content, to the new owners so that they can continue to provide the services to you. The new owners shall continue to comply with the requirements and obligations set out in these Terms of Service and the Privacy Policy.

In addition, we also have the right, at our sole discretion, to assign our obligations under these Terms of Service to third parties for performance.

Governing law and disputes

These Terms of Service shall be governed by and construed in accordance with Swedish law, without application of Swedish choice-of-law rules.

Any dispute or claim arising out of or in connection with these Terms of Service, or in case of breach, termination, or invalidity of these Terms of Service, shall be finally settled by Swedish courts, with Växjö District Court as the court of first instance, unless otherwise required by mandatory law.
